1. Introduction & Acceptance
Welcome to Heart of Daggers (“Company,” “we,” “our,” or “us”). We operate a platform that enables users (“you,” “User,” “Player,” or “Game Master”) to find, host, join, and engage in tabletop roleplaying game (“TTRPG”) sessions. At Heart of Daggers, we prioritize the freedom and fair compensation of our Game Masters by ensuring no non-compete clauses and full tip retention.
By accessing or using our website and services (collectively, the “Service”), you acknowledge that you have read, understand, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy (collectively, the “Agreements”). If you do not agree, do not use or access the Service.
2. Eligibility & Account Creation
2.1 Age Restriction
- You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
2.2 Account Information
- You agree to provide accurate, current, and complete information during registration and to promptly update such information to keep it accurate and complete.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- We reserve the right to suspend or terminate your account if any information provided is or becomes inaccurate, false, or misleading.
3. Communications
3.1 Consent
- By creating an account on our Service, you consent to receive promotional emails, newsletters, and other marketing communications. You can unsubscribe via the provided link within these communications at any time.
- Transactional emails (e.g., order confirmations, receipts) are not optional as they are necessary to fulfill and document transactions.
3.2 Notifications
- You are responsible for keeping your email and other contact information current so we can send you notices, statements, and other relevant information.
4. Platform Rules
4.1 Payment Processing
- All payments for TTRPG sessions (“Sessions”) or other products/services must be processed through Heart of Daggers’ platform.
- Accepting or requesting payments outside of our platform (e.g., PayPal, Venmo, direct wire) from users you connected with on Heart of Daggers is strictly prohibited.
4.2 No Table Splitting
- All Players in a Session listed on Heart of Daggers must be registered and must pay through Heart of Daggers. Splitting tables or circumventing the required payment process is prohibited.
4.3 Non-Interference with Data
- You shall not scrape, hack, reverse engineer, or otherwise compromise or impair the Service. Use of bots, crawlers, or any automated system to collect data from Heart of Daggers is strictly prohibited.
4.4 Three-Strikes Policy
- We operate under a “three-strikes policy.” Violations of these Terms or our Code of Conduct may result in warnings, suspension, and/or permanent removal from the platform. Severe misconduct may result in an immediate ban at our discretion.
4.5 No Non-Compete Agreements
Heart of Daggers does not impose any non-compete restrictions on Game Masters. You are free to advertise, promote, and host your adventures on any platform of your choice without any limitations imposed by Heart of Daggers. Your community and creative freedom remain entirely yours.
5. Purchases & Fees
5.1 Payment Information
- When making purchases through the Service, you may be required to provide payment details, including credit card number, billing address, and other financial information. You represent that you have the legal right to use the payment methods submitted.
5.2 Third-Party Processors
- We use third-party payment processors to facilitate transactions. By providing payment information, you grant Heart of Daggers the right to share this information with our payment processors in accordance with our Privacy Policy.
5.3 Fee Changes
- We are committed to maintaining a fixed 10% platform fee for GMs on paid sessions. This fee will never increase.
- We will never introduce premium features or paid upgrades – every feature on our platform is, and will remain, available to all users without additional charges. If any adjustments are ever made to other non-GM-related fees (such as unavoidable third-party processing costs), we will provide reasonable prior notice. Continued use of the Service after such notice constitutes agreement to any such changes.
5.4 Tip Retention
Heart of Daggers does not take any percentage from the tips you receive. All tips gifted by players are 100% yours to keep. We believe in fair compensation and ensuring that GMs receive the full value of their contributions.
5.5 Commitment to Fair Practices
Heart of Daggers is dedicated to maintaining transparency and fairness in all our operations. We ensure that all fees, policies, and procedures are clearly communicated to our users without hidden charges or deceptive practices. Our goal is to support GMs and players alike by providing a trustworthy and equitable platform.
6. Refunds & Cancellations
6.1 Refund Policy
- Refunds are not guaranteed and are at the discretion of Heart of Daggers, the Game Master, or as required by applicable law.
6.2 Disputes
- If you have concerns regarding a purchase or wish to request a refund, please contact us at help@heartofdaggers.com We will review the request on a case-by-case basis.
7. Code of Conduct
7.1 General Conduct
- Our Code of Conduct is a living document that outlines behavior expectations for all community members. You agree to respect and comply with it at all times when using the Service.
7.2 Harassment & Discrimination
- Harassment, hate speech, and discrimination based on race, gender, sexual orientation, religion, disability, or any other protected characteristic will not be tolerated and may result in immediate ban or legal action where appropriate.
7.3 Game Themes
- Some TTRPG Sessions may deal with mature content. Non-consensual sexual content, sexual content involving minors, or any other content that promotes sexual violence is strictly prohibited.
8. Content & Intellectual Property
8.1 User-Generated Content
- You may post or upload content (e.g., text, images, videos) through the Service. You warrant that you own or have the rights to use this content and grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, display, distribute, and make derivative works of your content.
8.2 Prohibited Content
- You must not upload or share content that is unlawful, infringes any intellectual property rights, invades privacy, or is offensive, threatening, defamatory, obscene, or otherwise objectionable.
8.3 Platform Ownership
- The Service, including all associated intellectual property rights (e.g., trademarks, logos, software), is the exclusive property of Heart of Daggers and/or its licensors.
9. Prohibited Uses
You agree not to use the Service:
- In any way that violates applicable laws or regulations.
- For fraudulent or harmful activities.
- To distribute spam or unsolicited messages.
- To impersonate Heart of Daggers, our employees, or another user.
- To introduce viruses, malware, or other harmful code.
10. Limitation of Liability & Disclaimers
10.1 Disclaimer of Warranties
- THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
10.2 Limitation of Liability
- HEART OF DAGGERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF THE SERVICE.
10.3 Indemnification
- You agree to defend, indemnify, and hold harmless Heart of Daggers from claims, damages, and liabilities arising from your violation of these Terms.
11. Termination
- We may suspend or terminate your account for any reason, including violations of these Terms. Termination does not affect provisions meant to survive termination.
12. Governing Law & Dispute Resolution
- These Terms shall be governed by the laws of the jurisdiction in which Heart of Daggers is established. You agree to resolve disputes exclusively in the courts of that jurisdiction.
13. Changes to the Service & Terms
- We reserve the right to modify these Terms. Continued use of the Service after modifications are posted constitutes acceptance of the revised Terms.
